These Terms & Conditions govern the services provided by Autumn In Tennessee, a registered assumed name (DBA) of Hunnicutt AI Media LLC, a Tennessee limited liability company ("we", "us", "our"). By requesting a design, booking a package or purchasing from us, you ("you", "the customer") agree to these terms.

Our services

We provide seasonal porch and entryway decorating in the greater Nashville area. Depending on the package you select, our service is either a delivery of materials or a full-service design and installation:

• Simple Harvest and Classic Autumn are drop-off packages. We source and deliver the pumpkins to your front porch. Arrangement and styling are done by you. Professional design and styling can be added for an additional fee at checkout.
• Grand Porch and Signature Estate include professional layout, design and on-site setup by our team.

Package contents are listed on our website and are accurate at the time of purchase. Specific pumpkin varieties, sizes, shapes and colours vary by harvest and availability; we substitute comparable items of equal or greater value when a specific variety is unavailable.

Free design concepts

Design concepts provided before purchase are complimentary visual illustrations created from the photo you submit. They are concepts, not guarantees. The finished display will reflect your actual porch, the materials available that season and the package you select, and may differ from the concept image. Requesting a concept places you under no obligation to purchase.

Eligibility

You must be at least 18 years of age to purchase from us, to book a service, and to consent to receive text messages from us.

Booking, pricing and payment

• Prices are those published on our website or quoted to you in writing at the time of booking.
• A booking is confirmed only once payment or the agreed deposit has been received and we have confirmed your date in writing.
• Any balance is due on or before the scheduled delivery or installation date unless agreed otherwise in writing.
• Prices do not include applicable sales tax unless stated.
• Add-ons such as hay bales, mums, corn stalks, lantern styling, design service for DIY packages, Thanksgiving refresh and end-of-season removal are billed at the published rate.

Scheduling, access and weather

We schedule delivery and installation dates in advance and will notify you of your window. You are responsible for providing safe, unobstructed access to the porch or entry area on the scheduled date, including access past gates, pets and parked vehicles. If we cannot access the property on the agreed date, a rescheduling fee may apply.

Severe weather may require us to reschedule for the safety of our team. We will contact you to arrange the earliest available alternative date. Weather rescheduling is not grounds for a refund.

Perishable goods and display lifespan

Display lifespan depends on temperature, humidity, rainfall, direct sunlight, pests, wildlife and how the display is handled after installation. We select quality materials and provide care guidance, but we cannot guarantee a specific lifespan for any item. Natural deterioration after delivery or installation is not covered and is not grounds for a refund or free replacement.

If an item arrives visibly damaged or decayed on the day of delivery or installation, contact us within 48 hours with photographs and we will repair or replace that item at no charge.

Cancellations, changes and refunds

• More than 7 days before your scheduled date: you may cancel or reschedule at no charge, and any deposit is refunded or credited.
• Within 7 days of your scheduled date: deposits become non-refundable, as materials have typically been sourced and your date reserved.
• After delivery or installation: because materials are perishable and seasonal, completed orders are non-refundable.
• Changes to package, scale or date are subject to availability and may change the price.
• We reserve the right to cancel and issue a full refund if we cannot safely or reasonably fulfil an order.

Your property

We take care when working on your property. You confirm that you own the property or are authorised to have work performed on it, and that any HOA, building or community approvals required have been obtained. We are not responsible for HOA fines or violations arising from your display.

We are not liable for pre-existing damage, or for ordinary wear such as marks on porous surfaces caused by the normal weight or moisture of decorative items. If we cause damage through our negligence, notify us within 48 hours and we will address it.

End of season and removal

Unless you purchase end-of-season removal, all materials become yours on delivery and their disposal is your responsibility. Removal service, where purchased, is scheduled separately at the end of the season.

Photography and media

We may photograph completed displays for our portfolio, website, advertising and social media. Photographs are of the display only; we do not publish your name, street address or house number without permission. If you prefer we do not photograph your display, tell us before installation and we will honour that.

SMS program, text messages and opt-out

Autumn In Tennessee operates an SMS program for customers and prospective customers in the United States. If you provide your phone number and check the applicable consent box on our web form, we may contact you by phone and text message.

What we send. Service and transactional messages confirming your design request, delivering your design concept, answering questions about packages and pricing, and scheduling your delivery or installation. If you separately consent to marketing messages, we may also send seasonal availability and special offers.

How often. Message frequency varies. You will typically receive between 1 and 8 messages per month depending on where you are in the process.

Consent to receive text messages is not a condition of any purchase.

You can opt out at any time. Reply STOP to opt out of further messages. Reply HELP for assistance, or contact us at [email protected] or (615) 235-1895 for support.

Carriers are not liable for delayed or undelivered messages.

You must be at least 18 years of age to consent to receive text messages from us. Our SMS program is not directed to anyone under the age of 18.

Limitation of liability

To the fullest extent permitted by Tennessee law, our total liability arising from your order is limited to the amount you paid for that order. We are not liable for indirect, incidental or consequential losses.

Governing law

These terms are governed by the laws of the State of Tennessee. Any dispute will be handled in the courts of Tennessee. If any provision is found unenforceable, the remaining provisions continue in effect.

Changes to these terms

We may update these terms from time to time. The version published on this page at the time of your booking is the version that applies to your order.
